Terms

The agreement between you and OpenTour. Plain English. Real obligations on both sides.

The deal

By using OpenTour you agree to these terms. We provide a virtual tour platform: uploading, hosting, viewing, AI-assisted setup, lead capture, and analytics. You bring the content; we run the platform.

Your content

You keep ownership of every scan, photo, and tour you upload. You grant us a non-exclusive licence to host and serve that content as required to deliver the product (and only that). We do not train AI models on your content.

You promise the content does not infringe anyone's rights and complies with the laws where the tour is published. You are responsible for the property facts you enter; the visitor AI grounds answers in those facts and we will not check them.

Acceptable use

  • No illegal content or use that violates third-party rights (privacy, copyright, trademark).
  • No publishing tours of properties you do not have permission to share.
  • No abuse of the AI tooling (automated scraping, prompt-injection attempts at scale, etc.).
  • No reselling the platform or sublicensing access without a written agreement.

Subscriptions and billing

Subscriptions are processed by Stripe and renew on the cadence shown at checkout. You can cancel anytime from the billing portal; cancellation takes effect at the end of the current billing period. We do not refund partial periods unless required by law.

Tier limits (active tours, monthly views) are enforced softly. We will tell you when you cross a threshold and ask you to upgrade rather than silently degrading the product.

Service level

We target high availability but do not promise a specific uptime number on shared tiers. Enterprise customers receive a separate SLA. We will let you know about scheduled maintenance windows in advance.

Termination

Either side can end the agreement. We can suspend or terminate accounts that breach these terms, with notice when reasonable. On termination you can export your tour data within 30 days; after that we delete it.

Liability

We are liable for direct damages caused by our negligence, capped at the amount you have paid in the prior twelve months. We are not liable for indirect, incidental, or consequential damages, including lost profits or data, except where the law does not allow us to limit them.

Changes to these terms

We will email signed-in customers if we materially change these terms. Continued use after notice means you accept the change.

Governing law

These terms are governed by the laws of the jurisdiction where OpenTour is incorporated. Disputes go to the courts there unless your local law gives you a non-waivable right to sue elsewhere.
